organizes the game " Le Bananas Game ", rom May 3, 2010 to July 9, 2010.

Article II : Participation

Participation in this game for free and without obligation to purchase is open to any individual of age (excluding the staff of the organizing company and their families) and has an e-mail. If the person is a minor, his participation implies that he/she has already received the consent of parents or the person having parental authority. In this regard, the Oxbow Company may request a proof of authorization of the representative of the minor for the submission of the allocations. Otherwise, the allocation will not be considered valid, it can not be delivered to the Winner and immediately put at stake again. Participation is limited to one per person (same name and e-mail) per household. Participation is strictly nominative and the player can not play, under any circumstances, on behalf of other participants or companies. Any registration form that is incomplete, illegible, sent after the deadline or in another form that the required one will be considered invalid. The winners will be selected among the participants. Each participant will receive, if they wish, newsletters from the organizer for free and without obligation and can unsubscribe at any time.
In case of dispute, French law is to be taken into account for the settlement of the conflict. Each participant takes on the responsibility to play in accordance with the legislation of his/her country on online games on the internet.

Article III : Terms

To participate, simply visit the site www.oxbowtotallybananas.com or respond to the invitation received by email that will be sent to subscribed members of the organizers and also to members of partner sites of the organizers, and validate its form. Participants can log onto the site www.oxbowtotallybananas.com from May 3, 2010 to July 9, 2010.

The information left on the web server by the person wishing to play will be forwarded to the organizing company, which will conduct the draw of the winners.
Registrations that are fake or in breach of these rules result in disqualification of the player. Also, the registrations with disposable email are strictly prohibited. The Organizing Company can not be held liable in the case of misdirected email. The Organizing Company reserves the right to conduct any verification for the purposes of this article.

Article IV : Allocation

This game has the following prize:
Three winners will be drawn at random from among those registered before July 9, 2010. The first will win a surfboard worth 719 €, the second an overall combination worth 240 € and the third an Oxbow T-shirt worth 35 €.

Article V : Designation of the winner.

The winners will be identified by a winner number. Only one winner per family will be accepted: same name, same address and same @mail. Winners will be notified by mail if it is correctly mentioned in the information summary associated with the game “The Bananas Game”. All false identity information or addresses lead to the nullity of the winner and all of his/her participations.

Each winner will be contacted by email by the advertiser and will have one month to validate his/her win directly from the advertiser, after which time the allocation will be considered lost. The advertiser is responsible for shipping the prize.
The prize cannot be a cash refund or any compensation of any nature whatsoever and is not transferable. However, in cases of force majeure, the co-organizers reserve the right to substitute the advertised prize by one or more prizes of at least an equal value. The winners authorize any identity checks. All false identity or position information will lead to the nullity of the winner and of all his/her participations.

Article VI : Legal Deposit

The settlement is filed with SCP Montel Siméone Segura Siméone M3S, 21 Rue Bonnefoy, 13006 Marseille. The rules can be changed at any time in the form of an amendment by the organizer in respect of the conditions set forth and published online on the site. The amendment is registered with SCP Montel Siméone Segura Siméone associated bailiffs custodian of the regulation before its publication. The settlement is sent for free to anyone making a request in writing before the closing date of the game. Article VII : Reimbursement of fees

Any participant may obtain on request the fixed reimbursement of fees relating to game time of a 3 min connection at discounted rate. The refund request must be sent by mail to the organizers, along with bank details on behalf of the owner of the hotline, a photocopy of the invoice for that month’s internet service provider, proof of subscription and a letter indicating an analogue or digital number (in the case of cable subscription, of the decoder) used for the participation, the date and time of connection, not later than 30 days after closing date of the game, by postmark date. The costs incurred by the participant for the stamp necessary for this request will be refunded upon written request by a 2nd class "letter" in force. Only one reimbursement application per registered participant in the game and per envelope (same name, same address). Incomplete applications will not be taken into account.

Article VIII : Connection and use

Participation implies knowledge and acceptance of the characteristics and limitations of the Internet, the lack of protection of certain data against possible misuse or theft and contamination by possible viruses circulating on the network. The organizers accept no responsibility for any misuse or incident relating to the use of the computer, Internet access, maintenance or malfunction of the game servers, telephone line or any other technical connection, and for sending registration forms to the wrong or incomplete address.

Article IX : Disputes and Liabilities

Participation in this competition implies the unconditional acceptance of the regulations in their entirety. Any inaccurate or misleading declaration, any fraud will result in disqualification of the participant. The organizer will decide autonomously any litigation relating to the game and its rules in accordance with the SCP Montel Siméone Segura Siméone M3S, bailiffs. No written or phone request concerning the interpretation or application of this Regulation, mechanisms or procedures of the game and also of the list of winners will be answered. The organizer reserves the right, if circumstances require it, to extend, modify or cancel this game in compliance with Article VI.

Article X : Using the winner's data

By accepting the prize, the winner authorizes the organizers to use its full name, mailing address or Internet address in any promotional event related to this game without such use being able to give rise to any consideration other than the won prize.

Article XI: Agreement on Evidence

Except in cases of obvious errors, it is agreed that the resulting information of the game systems of the organizer has probative force in any dispute as to the connection elements and computer processing of such information relating to the game.

Article XII: Assignment of jurisdiction

Participants are subject to French regulations applicable to contests and games. Any dispute which cannot be settled amicably shall be submitted to the Commercial Court of Paris.

Article XIII: Data Processing and Individual Liberties Act

The personal information collected as part of this game is processed in accordance with the Data Processing and Individual Liberties Act of 6 January 1978. All participants in the game have, pursuant to Article 27 of this Act, a right to access or modify any data that concern them. All requests for access, rectification or opposition must be addressed at the game's address.

Article XIV : Literary and artistic copyrights

In accordance with the laws governing the literary and artistic copyright, reproduction and representation of part or all of the components of these games are strictly prohibited. All brands are registered trademarks of their respective owners.
